Welcome to The Book & Toy Company website (the “Site”). This Website is provided as a service to our customers. The Book & Toy Company appreciates your interest in our company and your visit to our site. Below are the terms and conditions of use (“T&Cs”) of our site.

Please read the terms and conditions of use carefully before using the site as they govern the use of the site. It is understood that if you use the site to make a purchase, you have read, understood and accepted the terms and conditions and that you are obliged to abide by the terms and conditions established here. The Book & Toy Company, may change, edit, modify, delete, revise or update the terms and conditions of use from time to time without notice and the use of this Site after any change, edition, modification, deletion, revision or update that posted on the Site means that you agree to comply with the posted T&Cs. Therefore, when making purchases in our online store, it is understood that there is prior acceptance by the user of all the T&Cs established here.

1. TRADEMARKS

The brands, company name, trade names, distinctive signs of brands, logos, among others, displayed on this Site are registered or unregistered trademarks of The Book & Toy Company or of a third party that may be the owner of the displayed trademarks and that The Book & Toy Company has the corresponding permits for these purposes. Nothing contained on this Site or in the T&Cs serves to grant you by implication or otherwise, any right or license of any kind to the trademarks or brands displayed on this Site without the express written authorization of The Book & Toy Company or the third party that may be the owner of these.

2. SITE CONTENT AND COPYRIGHT

The text, trademarks, logos, images, graphics, photos, video files, application functions or any other digital media, and their configuration on this Site (“Content”), are subject to the protection provided by patents, copyrights, trademarks and other types of intellectual property protection. The Content may not be copied for commercial use or distribution, nor may it be modified, processed or published on other websites. Access to and use of this Site is intended solely for the purchase of products from The Book & Toy Company store for personal use, information, education, entertainment and communication. You may download, copy or print the Content from this Site for personal, non-commercial use only. No right, title or interest in or to the Content of this Site is transferred to you as a result of downloading, copying, printing or using this Site.

3. REGISTRATION, ACCOUNTS AND PASSWORDS

You are responsible for the security and personal protection of any password or username that you may use to access this site. You are responsible for all direct or indirect damages resulting from any activity carried out on this site that may be linked to your username or password. You are required to immediately notify The Book & Toy Company of any loss or theft of your password or username.

4. PURCHASES

This Site is designed to receive online purchases from anywhere in the world. Novertheless, deliveries can only be made within the national territory of Costa Rica, which will be carried out by the delivery company that The Book & Toy Company selects for said purposes. Any person with legal capacity may make purchases on this Site. The Book & Toy Company is not responsible for purchases made by incapacitated persons and/or minors.

5. PURCHASE PROCEDURE

The purchasing process is very simple, regardless of being the first time you buy at www.thebookandtoycompany.com or if you have already purchased before. No registration or prior data entry is required, just follow the following steps:

• • Select: choose the desired product, click on it and you will see a detailed description of the product as well as related products. If you decide to buy, on that same screen you can see the “Add to cart” button. Click on this, modify the quantity if necessary and that’s it.
  • Buy: once the product is in the cart you may continue browsing to add more products to the shopping cart or simply proceed to finalize the purchase. If you decide to complete the purchase here, you must click on “process order” and a form will appear where you must provide customer information. If it is the first time you buy on our Site, all the requested information must be included, but you are already an existing customer, only the requested spaces must be filled out.
  • Confirm: Once the information has been entered, click to confirm your order and choose the payment method. Once your order is complete, you will be sent an email confirming receipt and confirming the order details such as payment method, shipping address indicated etc. If there is an error in the address indicated or in any other point of the order, you must immediately Book & Toy by one of the following  means to get the error corrected:

6. PRIVACY

All information that the client reveals at the time of registering on the Site or at the time of making a purchase (personal and non-personalized identifiable information) will be treated only by the personnel designated for these purposes with absolute confidentiality and privacy, with the sole objective of approval and shipping of online purchases, as well as the prospecting and offering of other Book & Toy only products and services, all in accordance with the Law on the Protection of Individuals against the Processing of their Personal Data (LAW NUMBER 8968).

• • Personal Information: name, identification number, physical address, telephone number and email.
  • Non-personally identifiable information: IP address, browser type, domain name and paginations specific to www.thebookandtoycompany.com are collected to gain a better understanding of site development needs.

7. PURCHASE POLICIES

The Book & Toy Company reserves the right to approve and/or reject any order if it does not have the required information or exceeds the authorized limits for each purchase or to restrict quantities. In such cases we are not obliged to explain the reasons for said rejection, which will be notified by means of an email sent to the address provided by the client for such purposes.

Payment Methods:

All our prices are expressed in colones, legal tender of the Republic of Costa Rica and in US dollars. To make any purchase through the online purchasing system, the user may use any credit card or debit card as a means of payment. 

The Book & Toy Company is not responsible for purchases made on the site through the use of lost and/or stolen credit cards because our portal cannot detect these cases, nor does it have the power to deny the sale if the issuing bank has authorized the transaction.

8. USER WARRANTIES AND CLAIMS

Product guarantees

In the event that a product purchased through the site is found defective, the customer must proceed to notify The Book & Toy Company, within a period of 30 calendar days, The Book & Toy Company will as appropriate, evaluate, repair, replacement or refund the product, procedures that will be free for the purchaser or end consumer. Each item in The Book & Toy Company has a factory warranty assigned, which the customer can claim within 30 calendar days from the delivery of the product.

Returns and exchanges during the first 48 hours

If for any reason the customer is not satisfied (the product is simply not what they expected or they do not like it) they must inform The Book & Toy Company within 48 hours after receiving the product to proceed with the return of the article and refund of the customer’s money. This is applicable only for online purchases. The products must be returned to The Book & Toy Company via the Costa Rica post office branch in Escazú (P.O. box 550, 1250 Escazú). Alternatively the product can be returned to our shop in Santa Ana. The item must come in perfect condition. Shipping and transportation costs will not be refundable. This right to refund or replacement of the product is different from the warranty right that the customer enjoys in accordance with Costa Rican legislation.

The Book & Toy Company gives the customer a period of 48 hours from the delivery of the product to coordinate with The Book & Toy Company the return or exchange of the product if necessary. In the event that the customer wishes to exchange the product for a new one that has a commercial value greater than the one the customer purchased, they must pay the difference in addition to the shipping cost. Partial product returns are not accepted. After the 48-hour period has elapsed without having communicated the desire to withdraw, no request to return the product will be accepted.

Returns will not be accepted in the following cases:

• • When more than 48 hours have passed since the purchase was made.
  • When the product or packaging is in poor condition, it cannot be bent, scratched or mistreated in any way.
  • When the product is incomplete, is missing accessories, instructions or is in any way manipulated, used and/or broken.
  • When the products have been personalized or are not returnable for hygiene or other reasons.
  • When proof of purchase and delivery document are not provided.

The refund will be made once we receive the product in the warehouse and verify that it is in perfect condition.

The customer may only make use of this right to refund or exchange items due to non-satisfaction twice a year.

9. REFUND

Once the return is authorized, we will request payment refund to the cardholder from the bank issuing the credit or debit card. The refund time will depend on the issuing bank and the term will be from 3 to 45 business days.

10. PROMOTIONS

All promotions presented on www.thebookandtoycompany.com will be for the exclusive use of purchases through this means; they will not be applied in physical stores and can be used only once and for the time that the promotion is in effect and/or while supplies last.

11. PRODUCT AVAILABILITY

If the products are available they will always appear as such on the Site and can be added to the cart. If you require a product that you cannot find on the site, you can write to us at: shoponline@thebookandtoycompany.com and we will gladly help you if we can. If for any reason the system indicates that the product is available for purchase but at the moment of processing the order it is not available, the customer will be notified by the means assigned by the customer for such purposes (email, whatsapp or phone call).

Please note that the colour and images of the products may vary from one computer to another so The Book & Toy Company is not responsible if the product is not exactly the same as what appears in the image.

12. FACTURA ELECTRONICA

The invoice will be sent to the email provided by the client at the time the purchase has been authorized.

13. INDEMNIFICATION

The customer agrees to indemnify The Book & Toy Company from any action, demand or claim (including attorneys’ fees and court costs) arising from any breach by the Customer of these Terms and Conditions including, without limitation any arising: (i) for any aspect related to the improper use of the Site, the information contained in or through it; (ii) for libel, defamation or any other violating conduct of the client in use of the site, (iii) for violation of laws or international treaties relating to copyright or intellectual property contained or available on or through the site, or ( iv) for the use of the site by any unauthorized person who accesses the site, using the client’s User Name and Password.

14. APPLICABLE LAW AND JURISDICTION

The User, by using the Site expressly agrees to submit to the jurisdiction of the courts of Costa Rica, as well as to the substantive and procedural laws applicable to the specific case in force in Costa Rica; expressly waiving any other jurisdiction that due to your nationality, residence or place of business. It may be your responsibility now or in the future, to resolve any controversy that may arise due to the interpretation, compliance or execution of the provisions of these Terms and Conditions as well as for the purposes of regulating the commercial operations that occur between the User and The Book & Toy Company in the event of any controversy.
